Roaming cows create havoc at Mass. cemetery

SOUTHAMPTON, Mass. (AP) ? The vandals that damaged a Massachusetts cemetery this week have pleaded "moo."

Police say a small herd of cows knocked over 40 American flags and veterans' bronze grave markers, then snacked on a few flower arrangements, at the Center Cemetery in Southampton on Monday.

Motorists called to report that the cows were loose. Police contacted the owner, Henry Wykowski, who caught and removed the cows from the cemetery.

Chief David Silvernail says the cows are an "ongoing problem," and his department has responded to complaints about the roaming bovines three or four times since last spring.

Cemetery Commission member Robert Floyd tells The Daily Hampshire Gazette (http://bit.ly/WPQ4py ) he plans on asking the farmer to pay for the damage once he comes up with an estimate.

HUNTSVILLE, TX (1/30/13 )-- More than 63,000 offenders in the Texas Department of Criminal Justice participated in educational programs offered by the Windham School District during the 2011-2012 fiscal year, which have been found to decrease recidivism rates, increase employment opportunities, and result in higher wages and higher levels of educational achievement among participants, a study at Sam Houston State University found.

Faculty from the College of Criminal Justice and Correctional Management Institute of Texas at SHSU evaluated the effectiveness of education and vocational programs offered by the school district on offender outcomes. Some of the programs included were the Adult Basic Education Program, which includes literacy training and GED preparation; the Post Secondary Education Program, which provides continuing education in vocational and academic settings; Career and Technical Education, which integrates career path planning and technology training to prepare offenders for the workforce; and the Cognitive Intervention Program, which addresses thinking patterns and is designed to improve behavior.

The study was based on offenders released from TDCJ facilities in Fiscal Year 2009, whose activities were followed through 2012. In FY2009, there were 72,218 offenders released from state prisons, with 51,058 or 70 percent who participated in educational programs offered by the Windham School District. Offenders who participated in adult basic education classes achieved "significantly higher" reading, math and language scores than non-program participants, and those advancements, particularly in reading, resulted in much lower re-incarceration rates among offenders, the study found. The study compared recidivism rates among first time offenders with person, property, drug and other crimes with offenders who did not participate in the Windham programs.

In addition to education and recidivism, offenders who participated in Windham educational programs generally had higher earnings than those who did not. Participants in the vocational certification programs and cognitive intervention program earned "significantly higher" wages after their release from prison, with an average of $3,010.59 and $3,180.81 earned respectively each quarter. This compared to $2,843.65 and $2,795.39 earned quarterly by those who did not take part in Windham educational offerings.

The study, entitled "Evaluation of the Windham School District Correctional Education Program," was a collaborate effort between Sam Houston State University and Indiana University of Pennsylvania. The report is expected to be presented to various members of the Texas State Legislature.

In addition to the evaluation of the effectiveness of programs, the report also highlighted some of the district achievements in the 2010-11 academic year, during which nearly 74,500 offenders participated in correctional education programs. Among those were 35,000 offenders who participated in literacy programs, more than 1,300 who were in special education, and nearly 1,000 who enrolled in ESL classes. As a result, 5,169 GED certificates were issued to program participants, with 85 percent of those who took the test passed it. In addition, more than 8,000 offenders participated in post-secondary education efforts, earning 447 Associate's degrees, 31 Bachelor's degrees and nine Master's degrees.

Armed men rob California Gurdwara

Armed men barged into a Gurudwara in California city and took away the money from a donation box kept inside the complex, police said.

According to the local Livingston police in California, three robbers entered the Gurudwara through the front door early Sunday morning. One of the men was armed with a gun, while another with a knife. The third robber was unarmed.

The three men took a few thousand dollars from a donation box and left through a side door, joining two other men who were waiting outside, local newspaper Merced Sunstar quoted police as saying yesterday.

North American Punjabi Association (NAPA) president Satnam Singh Chahal also that the three men took money from the donation box and left through a side door.

Police Chief Ruben Chavez said all of the men were wearing hooded jackets or sweatshirts, concealing their identities. Police are searching for three unidentified men.

Chavez said while money has been stolen from the donation box before, it's the first robbery that he knows of at the Gurudwara. "This is more brazen because they did come in armed. Obviously it's someone who knew the temple because they knew where to go," he was quoted as saying.

"We're looking at different angles, and we will do our best to get to the bottom of it. We really want to identify who they are," Chavez said.

Sikhs make up nearly 20 per cent of Livingston's population.

In August, a Wisconsin shooting rampage at a Sikh Gurudwara left seven people dead.

Mayor Pro Tem Gurpal Samra, who worships at both of the city's Sikh Gurudwaras, classified Sunday's robbery as "very disturbing."

"I was in Fresno when I got the call," Samra said. "The first thing that flashed in my mind was Wisconsin, right away."

The Wisconsin incident was one of the reasons officials at the temple had surveillance cameras installed, said Narinder Dola, vice president of the temple.

Three person, including a woman, were present inside the Gurudwara at the time of incident.

Dola was glad those inside the Gurudwara didn't confront the robbers. "I think they did the smart move, they didn't do anything, they just kept quiet."

NASA to launch ocean wind monitor to space station

Jan. 29, 2013 ? In a clever reuse of hardware originally built to test parts of NASA's QuikScat satellite, the agency will launch the ISS-RapidScat instrument to the International Space Station in 2014 to measure ocean surface wind speed and direction.

The ISS-RapidScat instrument will help improve weather forecasts, including hurricane monitoring, and understanding of how ocean-atmosphere interactions influence Earth's climate.

"The ability for NASA to quickly reuse this hardware and launch it to the space station is a great example of a low-cost approach that will have high benefits to science and life here on Earth," said Mike Suffredini, NASA's International Space Station program manager.

ISS-RapidScat will help fill the data gap created when QuikScat, which was designed to last two years but operated for 10, stopped collecting ocean wind data in late 2009. A scatterometer is a microwave radar sensor used to measure the reflection or scattering effect produced while scanning the surface of Earth from an aircraft or a satellite.

NASA and the National Oceanic and Atmospheric Administration have studied next-generation replacements for QuikScat, but a successor will not be available soon. To meet this challenge cost-effectively, NASA's Jet Propulsion Laboratory in Pasadena, Calif., and the agency's station program proposed adapting leftover QuikScat hardware in combination with new hardware for use on the space station.

"ISS-RapidScat represents a low-cost approach to acquiring valuable wind vector data for improving global monitoring of hurricanes and other high-intensity storms," said Howard Eisen, ISS-RapidScat project manager at JPL. "By leveraging the capabilities of the International Space Station and recycling leftover hardware, we will acquire good science data at a fraction of the investment needed to launch a new satellite."

ISS-RapidScat will have measurement accuracy similar to QuikScat's and will survey all regions of Earth accessible from the space station's orbit. The instrument will be launched to the space station aboard a SpaceX Dragon cargo spacecraft. It will be installed on the end of the station's Columbus laboratory as an autonomous payload requiring no interaction by station crew members. It is expected to operate aboard the station for two years.

ISS-RapidScat will take advantage of the space station's unique characteristics to advance understanding of Earth's winds. Current scatterometer orbits pass the same point on Earth at approximately the same time every day. Since the space station's orbit intersects the orbits of each of these satellites about once every hour, ISS-RapidScat can serve as a calibration standard and help scientists stitch together the data from multiple sources into a long-term record.

ISS-RapidScat also will collect measurements of Earth's global wind field at all times of day for all locations. Variations in winds caused by the sun can play a significant role in the formation of tropical clouds and tropical systems that play a dominant role in Earth's water and energy cycles. ISS-RapidScat observations will help scientists understand these phenomena better and improve weather and climate models.

The ISS-RapidScat project is a joint partnership of JPL and NASA's International Space Station Program Office at the Johnson Space Center in Houston, with support from the Earth Science Division of the Science Mission Directorate in Washington.

Great Books for Kids and Teens: It's Monday 1/30! What Are You ...


We had a very busy week here! We took our sons and two friends up to the Poconos to my mom's house for a weekend of snowboarding, to celebrate my son's 15th birthday. The boys all had a blast, and I finally got some reading time, in front of the fire in the condo!

Here's what we read last week:

  • I finished Pigs in Heaven by Barbara Kingsolver and loved it even more than the first novel, The Bean Trees. I never wanted it to end, and days later, I am still thinking about Taylor and Turtle. Two of the best books I have ever read!
  • I am now reading I Still Dream About You by Fannie Flagg, this month's selection for one of my book groups. It's well-written and I am enjoying it, but Pigs in Heaven kind of ruined me for any other novel right now! I did get a lot of reading time in this weekend while the kids were snowboarding, though.
  • I also slipped in a quick little book, Tales from Outer Suburbia by Shaun Tan. I don't quite know how to describe it because it is so unique and quirky. I see that it is officially categorized as a children's/teen book (one review says grade 4 and up; another says grades 7-12), but some of the wit and irony is clearly aimed at adults. I will try to review it this week, so I can describe it more fully. Anyway, I liked it!
  • My husband, Ken, is reading The Likeness by Tana French. He still thinks the plot of this one is a bit far-fetched, but he's enjoying the excellent writing and sometimes even laughs out loud!
  • Jamie, 18, had a busy week with school and snowboarding, but he continued to read Shaman's Crossing, Book 1 of the Soldier's Son trilogy by Robin Hobb. He says it's OK, but the fantasy world in this novel has guns and he prefers fantasy worlds that are pre-gun.
  • Craig, 15, is still reading The House on Mango Street by Sandra Cisneros for his freshman lit class.
We were so busy last week that I didn't have time to write any reviews, but I did FINALLY sign up for some 2013 reading challenges - check out my choices and let me know what you have signed up for.

Aaron shakes up US men's skating with 1st title

OMAHA, Neb. (AP) ? Never mess with the guy who knows how to rumble.

Little-known Max Aaron won his first title at the U.S. Figure Skating Championships on Sunday and helped knock down three-time champion Jeremy Abbott to the last step on the podium. With two quadruple jumps and an arsenal's worth of other tricks in his "West Side Story" program, don't count the 20-year-old upstart out at the world championships in March, either.

Aaron screamed and shook his fists when he finished his program, then slid across the ice giving a Tiger Woods-like fist pump. (He was wearing red, appropriately, and it was Sunday.) When his marks were posted, Aaron's jaw dropped and the audience roared. He won the free skate in a rout to jump from fourth to first, and finished with 255 points overall, almost four better than Ross Miner.

Abbott, who had won three of the last four U.S. titles, dropped to third after a disappointing and flawed free skate.

Aaron was the U.S. junior champ two years ago, but has done little of note since then. Skating first of the top men, however, he wasted no time showing he intended to make a run at the title. He opened with two quadruple salchows, the first in combination with a double toe loop, and did seven other triples. Aside from a small turn out on a triple axel, all were done with such great speed and flow people watching at home on their couches were probably saying, "That doesn't look so hard, I could do that."

Aaron is more than just a jumping bean, however. His spins were excellent, so fast and tightly centered he was practically a blur. He jazzed up his footwork with high kicks and hops, the kind of flourishes audiences ? and judges ? love.

But it was his perfect portrayal of the bad boy in "West Side Story" that was most entertaining. As he heard the first notes of his music, he fixed the audience with a smirk and began snapping his fingers. He oozed attitude throughout the entire program, so much so it's a wonder the Jets didn't storm the ice and try and wipe the smile from his face.

His big score in the free skate ? 175.87 ? was going to be tough for Abbott, Miner and the rest of the guys to top. No one came close.

Third the last two years at nationals, Miner had a breakthrough at NHK Trophy, where he was the bronze medalist. That gave him confidence he could be the top American man, and he's skating with more polish and assertiveness than ever before. Every element in his program, to the old "Captain Blood" movie, was finished to perfection. There was no rushing out of jumps or awkward ends to spins. It's the kind of precision a skater has to have if he's to contend with the international crowd.

He, too, did a quad ? a gorgeous one, to boot ? and seven other triple jumps. His only flaw was singling an axel, a silly mistake that's sure to nag at him until next year's nationals.

Abbott will have plenty of regrets after a program that was barely even adequate for a skater of his caliber. He was so slow on the approach to his quadruple toe it looked as if he was going to stop and, no surprise, he landed on his rear end. But it was his other jumps that were more disappointing. He turned several planned triples into doubles, and his landings were scratchy and awkward. That's a no-no for anyone, but it was particularly bad for a skater who prides himself on his skating skills, including edge quality so fine the carvings could be sold as artwork.

Abbott knew it, too, banging his forehead with his fist as he skated off the ice. But when he saw the marks, even he looked stunned and the audience gasped.

Flames raced through a crowded nightclub in southern Brazil early Sunday, killing more than 230 people as panicked partygoers gasped for breath in the smoke-filled air, stampeding toward a single exit partially blocked by those already dead. It appeared to be the world's deadliest nightclub fire in more than a decade.

Witnesses said a flare or firework lit by band members started the blaze in Santa Maria, a university city of about 225,000 people, though officials said the cause was still under investigation.

Television images showed smoke pouring out of the Kiss nightclub as shirtless young men who had attended a university party joined firefighters using axes and sledgehammers to pound at windows and walls to free those trapped inside.

Guido Pedroso Melo, commander of the city's fire department, told the O Globo newspaper that firefighters had a hard time getting inside the club because "there was a barrier of bodies blocking the entrance."

Teenagers sprinted from the scene desperately seeking help. Others carried injured and burned friends away in their arms.

"There was so much smoke and fire, it was complete panic, and it took a long time for people to get out, there were so many dead," survivor Luana Santos Silva told the Globo TV network.

The fire spread so fast inside the packed club that firefighters and ambulances could do little to stop it, Silva said.

Another survivor, Michele Pereira, told the Folha de S. Paulo newspaper that she was near the stage when members of the band lit flares that started the conflagration.

"The band that was onstage began to use flares and, suddenly, they stopped the show and pointed them upward," she said. "At that point, the ceiling caught fire. It was really weak, but in a matter of seconds it spread."

Guitarist Rodrigo Martins told Radio Gaucha that the band, Gurizada Fandangueira, started playing at 2:15 a.m. "and we had played around five songs when I looked up and noticed the roof was burning"

"It might have happened because of the Sputnik, the machine we use to create a luminous effect with sparks. It's harmless, we never had any trouble with it.

"When the fire started, a guard passed us a fire extinguisher, the singer tried to use it but it wasn't working"

He confirmed that accordion player Danilo Jacques, 28, died, while the five other members made it out safely.

Police Maj. Cleberson Braida Bastianello said by telephone that the toll had risen to 233 with the death of a hospitalized victim ? he said earlier that the death toll was likely made worse because the nightclub appeared to have just one exit through which patrons could exit.

Officials counted 232 bodies that had been brought for identification to a gymnasium in Santa Maria, which is located at the southern tip of Brazil, near the borders with Argentina and Uruguay.

Federal Health Minister Alexandre Padhilha told a news conference that most of the 117 people treated in hospitals had been poisoned by gases they breathed during the fire. Only a few suffered serious burns, he said.

Brazil President Dilma Roussef arrived to visit the injured after cutting short her trip to a Latin American-European summit in Chile.

"It is a tragedy for all of us," Roussef said.

Most of the dead apparently were asphyxiated, according to Dr. Paulo Afonso Beltrame, a professor at the medical school of the Federal University of Santa Maria who went to the city's Caridade Hospital to help victims.

Beltrame said he was told the club had been filled far beyond its capacity during a party for students at the university's agronomy department.

Survivors, police and firefighters gave the same account of a band member setting the ceiling's soundproofing ablaze, he said.

"Large amounts of toxic smoke quickly filled the room, and I would say that at least 90 percent of the victims died of asphyxiation," Beltrame told The Associated Press by telephone.

"The toxic smoke made people lose their sense of direction so they were unable to find their way to the exit. At least 50 bodies were found inside a bathroom. Apparently they confused the bathroom door with the exit door."

In the hospital, the doctor "saw desperate friends and relatives walking and running down the corridors looking for information," he said, calling it "one of the saddest scenes I have ever witnessed."

Rodrigo Moura, identified by the newspaper Diario de Santa Maria as a security guard at the club, said it was at its maximum capacity of between 1,000 and 2,000, and partygoers were pushing and shoving to escape.

Santa Maria Mayor Cezar Schirmer declared a 30-day mourning period, and Tarso Genro, the governor of the southern state of Rio Grande do Sul, said officials were investigating the cause of the disaster.

The blaze was the deadliest in Brazil since at least 1961, when a fire that swept through a circus killed 503 people in Niteroi, Rio de Janeiro.

Sunday's fire also appeared to be the worst at a nightclub since December 2000, when a welding accident reportedly set off a fire at a club in Luoyang, China, killing 309.

In 2004, at least 194 people died in a fire at an overcrowded nightclub in Buenos Aires, Argentina. Seven members of a band were sentenced to prison for starting the flames.

Several years later, in December 2009, a blaze at the Lame Horse nightclub in Perm, Russia, killed 152 people after an indoor fireworks display ignited a plastic ceiling decorated with branches.

Similar circumstances led to a 2003 nightclub fire that killed 100 people in the United States. Pyrotechnics used as a stage prop by the 1980s rock band Great White set ablaze cheap soundproofing foam on the walls and ceiling of a Rhode Island music venue.

The band performing in Santa Maria, Gurizada Fandangueira, plays a driving mixture of local Brazilian country music styles. Guitarist Martin told Radio Gaucha the musicians are already seeing hostile messages.

"People on the social networks are saying we have to pay for what happened," he said. "I'm afraid there could be retaliation".

DAVOS, Switzerland (AP) ? Forget the endless debates about the euro or government debts. What does the future hold?

The World Economic Forum at Davos is always a showcase for new research, trends and ideas. And those at the annual gathering of the world's elite don't shy away from making predictions, even if they missed foreseeing seminal events like the Great Recession or the Arab Spring revolts.

Here are some predictions from this year's participants:

WEATHER AND WATER

Climate change will lead to more and more extreme weather, which will cause tremendous economic upheaval, predicts New York University economist Nouriel Roubini.

"It's not just that New York is going to be underwater 30 years from now," he said, referring to the devastation caused last fall by Hurricane Sandy.

Oxford University physicist Tim Palmer ? who said as a scientist he preferred probabilities to prediction ? noted there is a 10- to 15-percent chance that the Earth will warm by 6 degrees Celsius within a century, leading to "catastrophic consequences for humanity" ranging from extreme weather to rising seas.

Vali Nasr, dean of the School of Advanced International Studies at Johns Hopkins University, said many countries will start running out of water in the coming years.

"Water is the new oil," he said.

A TECHNOLOGICAL SURGE

Laura Tyson, a business professor at the University of California at Berkeley, said one of the great concerns should be "the employment effects of technology," with so many jobs being rendered obsolete by scientific or technological advances.

Discussions of such advances were everywhere at Davos.

Sebastian Thrun, a computer science professor at Stanford University and leader of Google's Self-Driving Car Project, said he thinks Google co-founder Sergey Brin's prediction that within five years driverless cars will be on the streets used by regular people is going to happen.

"It'll be a while before they're going to be mainstream, and there'll be all kinds of interesting questions coming about security, privacy, safety of the system as a whole," Thrun said. "But if they are available within five years for general consumers, I think within 15 years you ought to be able to buy one of those."

MENTAL ILLNESS UNDERSTOOD

Edward Boyden, an associate professor at the Massachusetts Institute of Technology who directs a neural engineering research group, says new technologies for analyzing the brain will produce significant advances in fighting mental illness.

"Right now we know that certain cell types in the brain are impaired in schizophrenia, or bipolar disorder or autism," he said.

If scientists can develop new technologies to image the brain and control the brain's cells, he said "over the next half-century or so we should be able to really understand how these networks" generate emotion.

Then, in the case of mental illness, "we can insert information into the cells in order to re-sculpt their dynamics and fix what's broken," Boyden said.

Technology entrepreneur Eric Anderson said biotechnology and medicine "are eventually going to be information sciences, with your genes... will determine treatment."

THE LIGHTEST STUFF

Julia Greer, an assistant professor of materials science and mechanics at the California Institute of Technology, says the world is craving a useful, ultra-superlight material to work with.

Her research group collaborated with Hughes Research Lab (HRL) and the University of California, Irvine, to recently develop the world's lightest solid material. She predicted that in 10 to 15 years it will be used as fuel cell catalysts, as acoustic damping devices on submarines, as anti-reflective layers in solar cells, and as components of vehicles sent into space.

The new material, called a micro-lattice, is made up of tiny hollow tubes of nickel-phosphorous that are angled to connect ? and contains 99 percent air, Greer said. It can also be used for high-temperature thermal batteries, heart stents and blood clot catchers, she said.

On a related topic, Roy Johnson, the chief technology officer for Lockheed Martin, predicted huge advances in 3-D printing.

POWER TO THE PEOPLE

One of the most famous predictions is Moore's Law, named after Intel co-founder Gordon Moore, which says that computing power doubles every two years or so. It has proven stunningly correct so far, putting new technological devices in everyone's pockets.

But how long will this law hold? Paul Jacobs, the CEO of Qualcomm, said it's not so certain anymore.

The implications of effectively infinite computing power are staggering ? no more waiting for a power-up or a download; every song, movie and TV episode instantly available; and even the possibility of what scientists call artificial intelligence.

But Jacobs told The Associated Press that the law might be valid only "a couple of more generations."

"I'm worried. In the next couple of nodes we're going to stop getting those numbers unless somebody figures out something," he said.

YOUTH OF THE WORLD UNITE

Former British Prime Minister Gordon Brown, now the U.N. special envoy for global education, said huge advances in the Internet and technology are enabling young people to connect with each other and "this is opening up the world in a way that has never happened before."

"Young people are beginning to see that the gap between the opportunities and rights they have been promised and the opportunities and rights that are delivered to them is wholly unacceptable," he said at a session on the forum's sidelines. "And the sense that they are being deprived of these opportunities and rights is, I think, going to be the big motivating force over the next few years."

DNA in stolen kisses could reveal sex offenders

SO ROMANTIC... when you kiss your partner passionately, not only do you exchange bacteria and mucus, you also impart some of your genetic code. No matter how fleeting the encounter, the DNA will hang around in their mouth for at least an hour. This means that women's saliva could contain evidence of unwanted attention in cases of assault, or even telltale signs of infidelity.

Nat?lia Kamodyov? and her colleagues at Comenius University in Bratislava, Slovakia, recruited 12 couples who agreed to kiss each other passionately for at least 2 minutes. Afterwards, saliva samples were collected from the women at 5, 10, 30 and 60-minute intervals. Because Kamodyov?'s method relies on detection of the Y chromosome, it can only be used to identify a man's DNA in a woman's saliva.

The results show that the man's DNA was still present and could be detected through amplification after at least an hour, and possibly longer. "We've shown it's possible to get a full profile, which could be useful in crime investigation to pinpoint the possible perpetrator among suspects or exclude those innocent," says Kamodyov?. Her team is investigating whether the DNA survives longer than an hour and whether it's obtainable from the mouths of women who have died (Forensic Science International: Genetics, DOI: 10.1016/j.fsigen.2012.07.007).

Judge rules La. retirement plan unconstitutional

BATON ROUGE, La. (AP) -- Louisiana Gov. Bobby Jindal's plan to shift future rank-and-file state workers to a 401(k)-style retirement plan is unconstitutional because it didn't receive enough support from lawmakers, a judge ruled Thursday.

"Because the Legislature did not pass this by a two-thirds majority, I think it's invalid," said state District Judge William Morvant in Baton Rouge.

Morvant sided with the Retired State Employees Association of Louisiana, which argued the pension plan change required the supermajority vote because the legislative actuary who analyzes retirement bills deemed it carried a price tag.

Neither the House nor Senate gave the bill a two-thirds vote on initial passage.

Jindal, who was out of town for a national Republican Party speech, issued a statement pledging to appeal Morvant's decision, an appeal that will go directly to the Louisiana Supreme Court.

"We are disappointed in the court's ruling and we look forward to a successful appeal. We're confident that the bill was constitutionally passed," the governor said.

The bill, approved in the 2012 legislative session, created an investment account similar to a 401(k) plan for state employees hired after July 1, 2013. That would stand in place of a monthly retirement payment based on salary and years of employment.

Under the changed system, the contributions made by the employee and the state would be invested, and the account would grow at the rate of investment earnings. The employee would never lose money for investment slumps, as in a traditional 401(k) plan.

Louisiana was set to become the first state in the nation to provide only the "cash balance" retirement plan for certain employees, without also offering federal Social Security benefits.

Passage of the cash balance plan was Jindal's lone significant victory on the retirement front in the last legislative session, after lawmakers refused most of his package of proposals to change benefits for existing workers.

The issue of the two-thirds vote was raised during House debate on the cash balance retirement plan, but House Speaker Chuck Kleckley, R-Lake Charles and a Jindal supporter, disagreed. The House voted to support Kleckley's ruling. Kleckley issued a statement Thursday saying he still believes the bill only needed a simple majority vote.

"The constitution is clear, and the Legislature didn't follow the rules," said Robert Klausner, a lawyer for the Retired State Employees Association. "If they want to pass the cash balance plan, they just have to do it the right way."

The switch to the new pension plan would apply to rank-and-file state employees and university staff, not to law enforcement or other workers deemed to be in hazardous duty. It also wouldn't change the retirement benefits offered to public school employees.

Supporters of the cash balance plan described the change as a way to rein in the costs of retirement programs that are billions of dollars short of the money they'll need to pay for all benefits promised. Opponents said the new investment account wouldn't give state workers enough of a safety net.

It's unclear whether the change would save the state money.

Financial analysts disagree widely on its implications, with the Legislature's retirement analyst saying the new plan could cost the state more and the analyst hired by the Jindal administration predicting hefty savings.

The competing analysts ? called actuaries in retirement lingo ? testified Thursday about the statistical models and assumptions they used to reach their differing conclusions.

Morvant, a Republican, said the governor's goal was a "noble one" to try to shrink the state's retirement costs, but he said the administration didn't follow the proper procedure for passing the bill.

Under a constitutional requirement adopted in 2010, any benefit change to a public retirement system that has a cost can only be enacted if two-thirds of the House and Senate agree.

Morvant ruled that the determination by the Legislature's chief actuary, Paul Richmond, that the cash balance plan would have a cost for the state triggered the two-thirds voting requirement because that analyst is constitutionally charged with reviewing legislation.

"I know of no authority for the Legislature to receive the constitutionally-mandated note from the legislative (actuary) and say, 'Great, we got it, now we can ignore it,'" the judge said.

Lawyers for the Jindal administration had argued that because the Legislature had competing financial analyses of the cash balance bill, lawmakers could decide which one to use in determining how to handle the legislation.

The stock had climbed $38.40, or 37 percent, to $141.66 in early afternoon trading Thursday as investors celebrated a fourth-quarter earnings report that Netflix Inc. released late Wednesday. Earlier in the session, the shares hit a new 52-week high of $149.17.

The results were highlighted by an influx of 2 million more U.S. subscribers to Netflix's Internet video service and an unexpected profit during the final three months of the year.

Netflix ended December with 27.1 million U.S. subscribers to its service that streams movies and TV shows over high-speed Internet connections. The company, based in Los Gatos, Calif., is aiming to reach 90 million subscribers.

Agassi shocked, saddened by Armstrong confession

MELBOURNE (Reuters) - Andre Agassi was shocked and saddened by disgraced cyclist Lance Armstrong's confession to using performance-enhancing drugs and the eight-times grand slam champion said tighter, more frequent dope testing procedures in tennis would be good for the sport.

The American, who co-founded a philanthropic organization with Armstrong and other athletes like Muhammad Ali, women's World Cup winner Mia Hamm and NBA champion Alonzo Mourning, said he had been convinced of Armstrong's innocence.

"Well, my reaction to it is the same as everybody. It was shock, hard to stomach, sadness, disappointment. I think 'anger' is a fair word," Agassi told reporters at Melbourne Park on Friday.

"I was certainly one of those that flat out believed him that long period of time. The thought of it not being the case was unconscionable to me."

Armstrong, 41, admitted in an interview with Oprah Winfrey last week that he used performance-enhancing drugs and lied about it for over decade, finally owning up to being at the centre of one of the biggest drug scandals in world sport.

In 2007, Agassi and Armstrong were two of the founders of the organization Athletes For Hope which helps educate professional athletes on how to raise money and the profile of charitable and philanthropic causes.

Armstrong is still listed as one of the founders of the organization on its website (www.athletesforhope.org), though he does not have a biography link on its front page.

The 42-year-old Agassi, who admitted to recreational drug use in his autobiography "Open", said he felt that tennis was relatively clean and doubted anyone would be able to get away with the systemic level of doping that Armstrong admitted to.

"It's a sport where I wouldn't know how to get away with that level of cheating. It's a year round sport," Agassi said.

"It's an out of body governance, a third party governance. When last I played, it was comprehensive in the sense of nearly every tournament, nearly week to week, blood, urine, out of competition testing.

"I don't know how it's changed, but if it's stayed the same at least that's a good thing."

Agassi tested positive for methamphetamine during his career, but lied to ATP officials about how it got into his system, claiming he had consumed a drink spiked with the drug.

He felt that his own drug use, and how he avoided a ban, may have helped tennis in pursuing more vigorous drug testing programs.

"You know, for their own reasons I might have played a part in it, for them going to WADA (World Anti-Doping Agency) and the governance that has no horse in the race," he said.

"That, to me, is a great thing.

"For me, it would have kept me from destroying a few years of my life. That's what I did to myself with the use of the recreational, destructive substance of crystal meth.

"It would have saved me on a lot of fronts."

Agassi was also keen for tennis officials to increase testing so that the sport was not tainted by claims and counter claims of hiding the extent of any problem.

"Anything that can protect the integrity of the sport, and those that aren't cheating should absolutely be considered," he added.

"The more the better as far as I'm concerned. The stricter, the better; the more transparency the better; the more accountability the better.

"It's sad to watch people who may question things for those that worked pretty darn hard.

"Describing a problem is a heck of a lot easier than solving it, is one thing I've learned. Let's always have the discussion of making it more comprehensive."

How did you create the list?
To start, we drew upon our top UK internet blogs lists from past years then asked an array of UK based internet marketers to nominate their favorite blogs and bloggers that cover search engine optimization, content marketing, search engine marketing, social media and other online marketing practices.
