Mark Twain's Guide To Article Marketing | Content for Reprint

Word Count: 751 Date:

Mark Twain is a favorite writer of many. He can turn a phrase like no one else, and he's particularly known for his clever, amusing and ironic sayings.

Much of his advice is timeless and truly can apply to all sorts of situations. What kind of advice would Mark Twain give if he was indoctrinating someone to the art of article marketing?

1 - "Courage is resistance to fear, mastery of fear, not absence of fear."

Article marketing is often done by business owners. They have a website, and they know they need to market the website to attract visitors. But doing online marketing is something that is completely foreign to them, so undertaking that task is a bit scary.

Article marketing is one of the most accessible forms of online marketing, because pretty much anyone can do it. But even so, there is still a learning curve. I run into people all the time who get frustrated and overwhelmed at the thought of having to learn the ins and outs of something that they're totally unfamiliar with, like writing and submitting articles. They give up almost before they begin.

I think Mark Twain would tell them that this situation that they're afraid of is an opportunity to show courage.

2 - "If it's your job to eat a frog, it's best to do it first thing in the morning. And If it's your job to eat two frogs, it's best to eat the biggest one first."

This is great time management advice. One of the biggest hurdles that beginners face is simply writing articles on a consistent basis.

Taking Mark Twain's productivity advice to heart, it would be a good idea to schedule your article writing first thing in the day. Don't put it off--the longer that you procrastinate the bigger and harder the task will seem.

3 - "The only way to keep your health is to eat what you don't want, drink what you don't like, and do what you'd rather not."

Unfortunately, what he says is true. We would all like it if life were a lot easier, if there was an effective shortcut to getting the outcome that we want, one that didn't require much discipline or effort.

When you start marketing with articles, you will eventually run into the issue of having to do things that are harder than you wished they were. Not that article marketing is hard--it isn't. But as human beings we love to see immediate results, and we would love to think that you can submit a handful of articles and then be ranked at the top of Google.

Unfortunately, it just doesn't work that way. You need to put in the work in order to see the results. That means writing quality content and submitting articles consistently month after month.

4 - "A man's character may be learned from the adjectives which he habitually uses in conversation."

The same could be said of the sentiments that a person habitually expresses in his articles. Your articles will be a key communication tool between you and your potential customers, and your readers will deduce things about you and your business from the way that your articles are written and your attitude toward your niche.

5 - "A round man cannot be expected to fit in a square hole right away. He must have time to modify his shape."

So true. So many times people want to start writing articles and be like Ernest Hemingway right out of the gate. There is also the common desire to do just a little bit of website marketing and then to hop up Google's rankings by leaps and bounds.

That can happen, but usually it takes time and consistent effort. You must work long enough on your article marketing to give your website enough time to "modify its shape" in Google's eyes, and you must give yourself time to learn how to write articles. You will increase your skill over time.

I really appreciate the sage advice of Mark Twain. It's so practical and said with a lot of truth, tenderness, and humor. With what you're facing as you start to submit articles for your website, consider what Mark Twain has to say and let it bring out the best in you.

Trial of pope's butler starts with setback for defense

VATICAN CITY (Reuters) - Pope Benedict's butler, accused of using his access to the pope to steal papers that he thought would expose Vatican corruption, suffered a blow on Saturday's first day of his trial when judges refused to admit evidence from the Church's own investigation.

Gabriele's arrest in May, after police found confidential documents in his apartment inside the Vatican, not only threw a spotlight on allegations of malpractice but also pointed to a power struggle at the highest levels of the Church.

The 46-year-old Paolo Gabriele, an unassuming man who served the pope his meals and helped him dress, looked pale at his first public appearance since May. He smiled as he chatted with his lawyer but often staring into space during a hearing that lasted just under two and a half hours.

His lawyer, Cristiana Arru, had asked the court to allow as evidence the results of an inquiry by a commission of three cardinals who questioned Vatican employees, including prelates, about the leaks of the documents to Italian media.

But chief judge Giuseppe Dalla Torre, sitting before a crucifix and with a large, framed picture of Benedict looking down from the wall, said the commission answered only to the pope and had "no relevance" to the Vatican City's penal code.

According to an indictment issued in August, Gabriele told investigators he had acted because he saw "evil and corruption everywhere in the Church" and wanted to help root it out "because the pope was not sufficiently informed".

Domenico Giani, head of the Vatican police force, told the court that 82 boxes of evidence had been seized in Gabriele's apartments in the Vatican and in the papal summer residence.

Arru had wanted to see the commission's transcripts in the hope that they could help to explain her client's motives.

19TH CENTURY CODE

Instead, trial evidence will be based solely on the results of the investigation by a Vatican prosecutor and Vatican police.

The trial is being held under a 19th-century criminal code, so Gabriele did not enter a plea and did not speak. He is expected to testify when the trial resumes on Tuesday.

In a mostly procedural session, the court split off the case of Claudio Sciarpelletti, a Vatican computer expert charged with helping Gabriele who was not present in court.

The session was attended by eight police witnesses. The other four witnesses, including the pope's private secretary, Monsignor Georg Ganswein, were not present but are expected to give evidence next week. Gabriele's family also did not attend

Dalla Torre, wearing a black robe with gold epaulettes and a white, ruffled cravat, said he hoped to wind up the proceedings next week. It was not clear when the verdict would come.

The self-styled whistle-blower, who wore a smart light grey suit and light grey tie, could be jailed for four years.

Gabriele, who has said he saw himself as an "agent of the Holy Spirit", is widely expected to be found guilty because he has confessed.

"He has done harm by leaking this information because there will always be somebody who will take advantage of these things to denigrate the Church," said Rome resident Sergio Caldari in Saint Peter's Square.

Another local onlooker, Giovanni Maisto, said he was hopeful that the trial could mark "a new dimension of openness and transparency" in the Church's affairs.

Gabriele, a father of three who lived a simple but comfortable life in the city-state, told investigators after his arrest that he believed a shock "could be a healthy thing to bring the Church back on the right track".

MONTHS OF INTRIGUE

His capture capped nearly five months of intrigue and suspense after a string of documents and private letters found their way into the Italian media.

It was the latest embarrassment for a Church still reeling from the scandal of worldwide sexual abuse by members of its clergy.

The most notorious of the letters were written to the pope by Archbishop Carlo Maria Vigano, currently Vatican's ambassador to Washington, who was deputy governor of the Vatican City at the time.

In one, Vigano complains that when he took office in 2009, he discovered corruption, nepotism and cronyism linked to the awarding of contracts to outside companies at inflated prices.

Vigano later wrote to the pope about a smear campaign against him by other Vatican officials who were upset that he had taken drastic steps to clean up the purchasing procedures.

Despite begging not to be moved, Vigano was later transferred to Washington by Secretary of State Cardinal Tarcisio Bertone, effectively the Vatican's prime minister.

Since the papal state has no prison, Gabriele would serve time in an Italian jail, though the pope is widely expected to pardon him.

Television cameras, tape recorders and computers were not allowed into the court, a small, wood-paneled room with an ornate papal emblem on its ceiling.

The eight journalists allowed to cover the hearing were even blocked from bringing their own pens inside for fear that they could contain hidden recorders or cameras. (additional reporting by Gavin Jones and Eleanor Biles; Editing by Kevin Liffey)

Weekend Reading for Financial Planners (Sep 29-30) - kitces.com ...

Enjoy the current installment of "weekend reading for financial planners" - this week's edition starts off with a response from the CFP Board to the recent challenge about whether their fiduciary standard is "a joke" (not surprisingly, the CFP Board suggests that its standard is no joke), along with an article from the Advisor One blogs by Knut Rostad of the Institute for the Fiduciary Standard suggesting that HighTower Advisors is overstating their lack of conflicts of interest to the detriment of advancing the standard, and another article by Dan Moisand that suggests better regulation of financial planning will ultimately be a necessary step to be fully recognized as a profession. From there, we look at some interesting stats suggesting the fiduciary RIA world is grabbing market share of 401(k) plans just as it has been grabbing market share of retail investment advice, and an article about a planning firm that focuses on career coaching and compensation advice as a core deliverable to clients. There are also a number of technical articles, including a discussion of the emerging investment concept of "risk parity" and why it matters, a look at where and how tactical asset allocation will and won't work, the apparent underutilization of Section 529 college savings plans by financial planners, an analysis of when tax deferral does and does not make sense. and two deep estate planning articles (one focused on estate tax strategies before the end of the year, and the other on recent legal and tax developments over the past year). We wrap up with a lighter article about the importance of body language and what you may be unwittingly communicating in meetings, along with some advice to help ensure you're in the right state of mind heading into a (client) meeting (because if you're not, your body language is going to show it!).?Enjoy the reading!

Weekend reading for September 29th/30th:

Why Our Fiduciary Standard Is No Joke - This article on the Wall Street Journal blog is a response from CFP Board CEO Kevin Keller to the recent article "Is The Fiduciary Standard A Joke" (covered in Weekend Reading two weeks ago), an article by Allan Roth which criticized the CFP Board for doing a poor job enforcing its fiduciary standard in a particular case the article's author encountered a few years ago. The CFP Board notes that the incident in question actually happened in 2005 and 2006, which was before the CFP Board required a fiduciary standard for advisors (which took effect in 2008), and that more recently the organization has been increasingly pushing the fiduciary standard for CFP certificants and lobbying for it more broadly as well. In fact, the CFP Board makes the case that its pro-fiduciary positioning is part of why the credential is the most recognized of financial planning designations with the public, why the CFP certificant base has grown 24% in the past 5 years, and why CFP professionals are more productive than their peers according to a recent Aite Group survey.?

HighTower Advisors: The New Face of Fiduciary? - This blog post by Knut Rostad, President of the Institute for the Fiduciary Standard, calls out Elliot Weissbluth of HighTower Advisors for his recent statement at the MarketCounsel RIA conference that the HighTower business model has "zero conflicts of interest." As Rostad notes, a true standing of "zero conflicts of interest" is both not feasibly possible, and notably is not required of fiduciaries, either; ultimately, fiduciaries are expected to avoid the most significant conflicts of interest that can be avoided, and manage the rest. When pressed on the issue by Rostad, Weissbluth acknowledged that "zero" conflicts may not be possible, stating that "You are always going to have some technical conflicts" and that what he meant was that HighTower avoids the traditional wirehouse conflict of "getting paid twice" when working with clients. Rostad then draws parallels between HighTower's apparent fiduciary position, and that of SIFMA, implying that both are seeking to redefine or dilute a true fiduciary standard, as there is no such thing under the law as a distinction between a "conflict of interest" and Weissbluth's "technical conflict of interest" and that to have any conflicts of interest, "technical" or otherwise, means a claim of "zero conflicts of interest" is patently false and contrary to consumer interests. This article is a notable distinction from most articles about HighTower that have been far more upbeat, although ultimately Rostad's point is not about HighTower, per se, but to emphasize that reaching a true fiduciary standard for advisors requires acknowledging what it does and does not say, and to be clear and not misleading about what conflicts of interest do and do not exist.

So Close and Yet So Far - This article by Dan Moisand in the Journal of Financial Planning explores whether financial planning is yet a "profession" and concludes that it is not, in large part because of regulation - specifically, that our current ability to actually enforce a financial planning code of ethics, with real consequences for inappropriate actions, is limited. The associations have a Code of Ethics, but no enforcement (as discussed previously on this blog); the CFP Board has some enforcement, but its sanctions are limited as it is ultimately a private entity that grants the marks, not a governmental entity that can apply the force of law. The article then discusses some potential avenues for better regulation of financial planning, noting that it doesn't necessarily have to be scary or onerous, but the ultimate goal is to ensure that the only people who really use a label like "financial planner" (or something similar) are those who are actually qualified to do so.

Cerulli: RIAs and Hybrid RIAs Make Giant Advances On Banks And Wirehouses In The 401(k) Race - This article from RIABiz highlights a recent Cerulli study showing that RIAs and hybrid RIAs operating as fiduciaries are already picking up dramatic market share of 401(k) assets. Wirehouse 401(k) assets dropped from $532 billion to $510 billion and banks from $60 billion to $54 billion from 2010 to 2011, while RIAs jumped from $118 billion to $152 billion and hybrid RIAs leaped from $86 billion to $143 billion; most other channels were relatively flat. And with the many of the Department of Labor's new fee disclosure rules just taking effect, many are suggesting that the RIA market share may grow even faster from here, as more and more plans and participants become aware of the fees they're paying, and that RIAs with a leaner structure can render services for a much lower cost.

Stewart Koesten, KHC Wealth Management Profile - As the name suggests, this article is a profile of the practice of Stewart Koesten of KHC Wealth Management. What makes Koesten's practice interesting is that it focuses heavily on a client's human capital - with executive coaching, career transition planning, and compensation coaching, in addition to more "traditional" financial planning services. The latter are provided on a traditional AUM basis, but the former appear to be delivered primarily on an hourly model, tailored to the exact issues of the particular client situation, and provided by a staff member with experience as a coach.?

Why Risk Parity Matters Now More Than Ever - This article provides a nice primer on the concept of "risk parity" - which is a strategy of portfolio design where risks are diversified not just with low correlation assets, but where the risks that drive those asset classes, such as growth, inflation, or market sentiment, also have little relationship to each other. And the goal is to do this in a manner where overall risk exposure remains constant - which actually means asset class exposure may vary as risks and returns shift. For instance, to maintain the same level of risk and volatility in the 1930s and the 1980s would require different levels of equity exposure. The key distinction is that just owning a number of different investment managers doesn't necessarily achieve the desired diversification and risk parity, if the managers are all subject to the same overall market flows. To some extent, this is simply another way to frame asset allocation, but in this case the focus is truly on different asset classes - i.e., asset classes exposed to different risks - with an acknowledgement that as risk/return opportunities to asset classes change, so too should asset allocation to maintain consistent risk exposure.

Tactical Think Tank: A Fundamental Answer for Tactical Asset Allocation - This article from the Journal of Financial Planning is an exploration of some firms that began researching options for how to implement a more tactical investment management process. Their conclusion was that short-term market timing remains impossible, but that there are intermediate and long-term market trends that can be predicted, which notably impact not only asset allocation shifts over time, but also the underlying financial planning assumptions used with clients. The research approach extended in two directions - one group looked at factors related to technical analysis, while the other studied fundamental analysis (such as P/E ratios and regression to long-term trend lines). The article then shows how some of the techniques can be applied to adjust long-term projections for asset class returns, and how those adjustments in turn can impact financial planning assumptions. The bottom line is that as long as the adjustments are done in the context of longer-term planning and projections, the data appears to support a somewhat more tactical approach to portfolio design and return assumptions.?

529 Plans: Untapped Potential of College Savings - This article from Financial Planning magazine looks at how parents are using 529 plans to help save for college in this age of "stratospherically high tuition costs." However, the article suggests that the plans may still be underutilized by planners, as only about 27% of money saved for college was in 529 plans (according to Financial Research Corp). The article suggests this may be due in part to the fact that often advisors cannot charge fees or earn commissions on 529 plan assets (although a chart included with the article shows that the American Funds advisor-sold 529 plan is by far the largest of the 529 plans), although others suggest it may more be a factor of mediocre market returns leaving investors generally unsupportive of market-based 529 plan offerings (as 529 contributions tend to show a strong relationship with overall market returns). The article then provides a series of 15 advantages for 529 plans, and 13 "notes of caution" - although there's not a lot new here, there are some good tidbits, and a lot of helpful reminders that can be used as talking points with clients.

Tax Deferral: When Does It Make Sense and When Does It Cost Cents (or Dollars)? - This article from the Journal of Financial Planning provides a strong analysis to understand when tax deferral makes sense, and when perhaps it doesn't - which is especially true in situations where deferring taxes may result in higher future tax rates (either because the strategy causes higher tax rates, or simply because Congress changes the rates). The article then develops a series of 10 "rules" associated with tax deferral that provide some helpful rules of thumb, ranging from the general (if tax rates are anticipated to rise, tax deferral doesn't make sense unless the deferral period is very long) to the specific (hold tax-exempt bonds that have appreciated but sell those that have declined in value, due to the underlying tax treatment). Overall, this article provides some nice reminders and a few "surprises" in recognizing that there are many situations where tax deferral really isn't worthwhile.

Helping High Net Worth Clients to Act Before Possible Cut in Tax Exemptions - This article by estate planning attorney Martin Shenkman in Financial Planning magazine looks at estate planning strategies for clients who wish to take advantage of the current gift and estate tax exemptions before they potentially fall to lower levels as scheduled to occur in 2013. Of course, the basic strategy is to gift and take advantage of the $5.12 million exemption before it expires, but the article digs further into particular strategies to implement this. For instance, gift to a trust for asset protection purposes, not outright; structure it as a grantor trust, so the client can pay taxes from within his/her estate to let the assets in the trust outside his/her estate grow even faster; consider using a family limited partnership or LLC to leverage the gifts further with valuation discounts, but be cautious not to push the IRS' rules too far on this; consider putting assets in a revocable living trust, and grant the trustee gifting powers so that in the future the trustee can execute gifts if the client becomes incapacitated. The bottom line is that a lot of this can be done fairly quickly if necessary, but it's probably desirable to use the remaining months of the year to more effectively plan out details and strategies. Depending on the practice, not many clients will necessarily have the net worth to manage such gifts, but for the ones that do, huge tax savings are potentially on the table.?

Recent Developments In Estate Planning - This article by Justin Ransome and Frances Schafer of Grant Thornton in the AICPA's Tax Adviser provide a nice and deeply technical update on some of the latest legal and tax developments in the estate planning world. The most significant is the recent decision in the Estate of Turner, Tax Court Memo 2011-209, which found that payments on life insurance in an ILIT qualified as a present interest gift because the beneficiaries of Crummey withdrawal powers, even though?it's not clear if the beneficiaries were ever notified of their withdrawal rights - the implication being that perhaps it's not necessary to actually send out Crummey notices to beneficiaries after all. Other notable recent developments include several court decisions involving valuation definition clauses favoring taxpayers, the deductibility of fees for trusts (including the need in some situations to unbundle investment management fees from tax return and other fees, because the former are subject to the 2%-of-AGI floor while the latter are not), and more.

Your Body Language Speaks for You in Meetings - This article from the Harvard Business Review blog provides a nice reminder not just about the importance of body language, but with a focus on what you can do to be certain you're well prepared for a meeting so that your body language doesn't convey or create a problem. For instance, make sure you've eaten recently, so that your brain is well fueled and you're not distracted; make sure you're well prepared for the meeting; if you're angry or have issues with someone outside the meeting, get it sorted out beforehand so that you're not aggressive in the meeting instead. In addition, try to be self-aware in the meeting itself; are you fidgeting and communicating that you're distracted? Are you interrupting too much? Although this article was writing with business meetings in general in mind, it provides some nice reminders for financial planners who spend a lot of time in meetings with clients.?

Canadians don't want Parliament to focus on China oil deal: poll

OTTAWA (Reuters) - In a sign Canadians may accept CNOOC Ltd's $15.1 billion bid to buy Canadian oil company Nexen Inc, a poll released on Friday showed few people want Parliament to focus on foreign ownership of the energy sector.

The Ipsos-Reid survey for Postmedia News and Global Television said only 22 percent of those surveyed felt investment in, or ownership of, the energy sector by China or other countries should be one of Parliament's top priorities.

Prime Minister Stephen Harper says his Conservative government will take public opinion into account before deciding whether to approve the takeover, which would dwarf the previous record purchase of a Canadian energy asset by a Chinese company.

The Conservatives are split over the bid, with opponents citing China's human rights record and what they say are Beijing's unfair business practices.

Ipsos-Reid said 68 percent of Canadians surveyed felt Parliament should focus on healthcare with 66 percent opting for job creation measures.

It also said only 16 percent wanted to see action on pushing through TransCanada Corp's proposed Keystone XL pipeline, which would take oil to Gulf Coast refineries in the United States.

U.S. President Barack Obama has put off a decision on whether to approve the pipeline until after the November 6 presidential election. That delay prompted Harper to declare that Canada must diversify its export markets and sell oil to China and other Asian nations.

The Ipsos-Reid online survey of 1,014 Canadians was carried out on Sept 25 and 26.

Online polls do not have a margin of error. A phone poll of a similar sample size would be considered to be accurate to within 3.1 percentage points, 19 times out of 20.

Education of Business Online from NCSU Network Marketing Tips ...

As a rep in MLM, I?m sure you cannot have helped but noticed that there are many network marketing companies out there. The competition can be furious! Some maybe wondering, what network marketing tips for guaranteed success do I need to be utilizing?

There are actually many factors to study in order to be successful in your home based business. Here are some things you can consider following:

1. Make a decision. With network marketing, one of the many ways to be successful is by learning to brand yourself and stand out and way above all the competition. Don?t try to do it all. Instead, learn to be become highly skilled in a very small niche and help others. For instance, maybe you can learn to become an expert in video marketing, Facebook, article writing, etc. There are many ways you could go.

2. Talk/teach in the ?colors? language. I am sure you have heard about how everyone has various personality types. Prospects are truly very different. Always think about, for example, what would a green, yellow, blue, or red need or want in a sponsor? Also think, what would your customers of different personalities respond best too?

3. Be aware of the difference between you and others. Think about how you want to be different from other reps and company competitors. Learn to show how you are different and use it to set up a benefit to your prospect.

4. Change your mindset to ?family? business. Remember, in network marketing, it is all about the relationships. When you begin to build a team/downline, think of it as ?family? and learn to express this to others. You will be in a much better way to serve your team members and customers.

5. Have testimonials. One of the best network marketing tips for guaranteed success you can learn is to become an expert storyteller. Learn to tell stories and gather stories to share; get permission to use people?s stories and/or testimonials. Most people love stories and respond to them.

6. Don?t be a time waster. In this business, you cannot fire hose prospects, and use hard sales techniques to get people in on your deal. If you try to do things like this, it will only backfire on you. If you learn to become a good listener and learn how to ?find out what people want and help them get it? as Harry Browne says, you will be able to build your business.

7. Keep it simple. Any marketing, advertising, or presentations you do should be very simple. People can?t stand complexity and confusion. If you present things in a complex way, they will immediately think, ?I would never be able to do that.?

8. Avoid trying to stand out merely for good quality and fantastic service. Prospects no longer respond to this since everybody says this. Avoid using these as a technique as it has no impact at all. Be yourself and not someone you are not. People will respond to that.

9. Learn some writing skills. One of the most important things you as a rep can learn is how to write fantastic headlines. The headline can actually make or break any type of copy writing you are dong whether it is for articles, blog writing, video marketing, various ad campaigns, etc

10. Give good reasons why a client, customer, or prospect should choose you. Use this to clearly show the benefit the person would have with working with you.

As you can see, these can be some pretty effective network marketing tips for guaranteed success for you to consider as you work towards becoming a leader. Choose a couple to get started on today, and your home based business can indeed grow over time!

Editorial: Apple apologies actually aren't that infrequent, and that's okay

Editorial Apple apologies actually aren't that infrequent, and that's okay

Today, Tim Cook made his first major apology as the CEO of Apple. It probably won't be his last. Despite the obvious knee-jerk reaction regarding the Maps debacle, it's actually interesting that this particular scenario is yet another example of humans having extraordinarily short-term memories. It's the same reason that whatever game we most recently saw is the "best or worst ever." (Packers v. Seahawks 09.24.2012, I'm looking at you.) In truth, Apple has a fairly solid history of ingesting pride in the iPhone era, when it surged headfirst into the realm of serving consumers in a way that it never had before. And moreover, hearing Cook apologize isn't something that should be mocked or berated; one can only hope that more companies of all shapes and sizes develop a policy of listening and reacting. Allow me to explain.

Health insurance premiums up $3,000 since Obama was elected ...

From Investors Business Daily.

Excerpt:

During his first run for president, Barack Obama made one very specific promise to voters: He would cut health insurance premiums for families by $2,500, and do so in his first term.

But it turns out that family premiums have increased by more than $3,000 since Obama?s vow, according to the latest annual Kaiser Family Foundation employee health benefits survey.

Premiums for employer-provided family coverage?rose $3,065 ? 24% ? from 2008 to 2012, the Kaiser survey found. Even if you start counting in 2009, premiums have climbed $2,370.

What?s more, premiums climbed faster in Obama?s four years than they did in the previous four under President Bush, the survey data show.

There?s no question about what Obama was promising the country, since he repeated it constantly during his 2008 campaign.

In a debate with Sen. John McCain, for example, Obama said ?the only thing we?re going to try to do is lower costs so that those cost savings are passed onto you. And we estimate we can cut the average family?s premium by about $2,500 per year.?

At a campaign stop in Columbus, Ohio, in February 2008,?Obama promised?that ?We are going to work with you to lower your premiums by $2,500. We will not wait 20 years from now to do it, or 10 years from now to do it. We will do it by the end of my first term as president.?

But are Obama?s policies?responsible?for the increase?

the health reform law Obama signed in March 2010 has pushed up insurance costs.

In 2011, premiums spiked 9.5%, and many in the industry blame ObamaCare for at least part of it. Premiums climbed another 4.5% in 2012, Kaiser found.

And ObamaCare will continue to fuel health premium inflation.

First, the law piles on new coverage mandates. It requires insurance companies to provide 100% coverage for various types of preventive care, bans lifetime coverage limits, extends parents? coverage to offspring up to 26 years old, and requires plans to meet certain ?medical loss ratios.? Coming up are rules on ?essential standard benefits,? limits on deductibles, bans on annual spending caps, and much more.

The experience with state mandates show that they only tend to grow over time, and get more expensive. The?Council for Affordable Health Insurance?found more than 2,200 state benefit mandates, which add from 10% to 50% to the cost of coverage.

?One of the biggest cost drivers in our health care system is the steady proliferation of federal and state-based coverage mandates,? noted CAHI?s Victoria Craig Bunce.

Meanwhile, ObamaCare?s insurance reforms ? guaranteed issue and community rating ? will likely raise premiums, too.

More regulation of health care companies means higher premiums. The more coverages that are mandatory, the higher premiums will go. If abortions have to be covered, then premiums go up.

Here are a few articles that I have been using lately to inform people about the problems with Obamacare:

It?s important to understand that people who oppose this law don?t oppose because we are just being contrary. Obama?s health care plan has the goal of destroying private medicine and putting everyone into a single-payer system like Canada?s. It?s not good for us to be waiting in line for MRIs for months and months, or even years and years. NO.

Depending on your condition of residence, work standing and profits, it is possible to be entitled to that loan of up to $1500, however some creditors will loan a maximum of $500. You'll have a possiblity to observe how much you be eligible for a just before accepting any kind of mortgage loan contract.

There is certainly an essential legitimate difference between a present along with a loan. A very nice family member or even pal could give you $5000 regarding auto repairs, for example. When there's no expectation of payment, the cash could be a gift. The giver couldn't take legal action against regarding repayment after inside a city match. However when the loan supplier designates the amount of money just like a bank loan and also the customer will pay back even a dollar, the amount of money can be viewed a legitimate loan and also the loan company can need repayment whenever. Many loan programs are usually addressed by finance institutions or another professional lenders. They could make use of a variety of criteria to determine if your potential customer is qualified for a financial loan. Previous credit rating is virtually always deemed, together with current revenue and also assets. Oil extends losses as economy pessimism persists

BANGKOK (AP) ? The price of oil fell below $91 a barrel Wednesday in Asia, tracking stock markets which dropped on renewed pessimism about the outlook for economic growth.

Benchmark crude was down 62 cents to $90.75 a barrel at midafternoon Bangkok time in electronic trading on the New York Mercantile Exchange. The contract dropped 56 cents to settle at $91.37 a barrel Tuesday in New York.

Oil failed to get an enduring boost from an improvement in U.S. consumer confidence to its highest level since February. Markets were overshadowed by comments from Charles Plosser, president of the U.S. Federal Reserve's Philadelphia branch, indicating that the Fed's efforts to support the world's biggest economy would likely fall short of its goals.

The comments reinforced the current pessimism about growth prospects, and dragged down stocks on Wall Street and then Asia. Benchmark crude has fallen from near $100 since the middle of last month. Energy prices tend to fall when growth is slow because of lower demand.

The U.S. economy is growing slowly. There also are concerns that Europe's debt crisis will continue to weigh on the global economy. China's export-driven economy has cooled off, largely due to Europe's problems.

Brent crude was down 65 cents at $109.80 a barrel on the ICE futures exchange in London.

In other energy futures trading on the New York Mercantile Exchange:

? Heating oil was down 1.2 cents at $3.095 a gallon.

? Wholesale gasoline gained 0.7 cent to $2.83.

? Natural gas gained 2.6 cents to $2.95 per 1,000 cubic feet.

Federal Court Denies 501(c)(3) Tax-Exempt Status for "Family Trust" Because of Inurement and Commerciality

Search_sealEarlier this week the U.S. District Court for the District of Columbia denied exemption under section 501(c)(3) for an entity that serves as the trustee for a trust benefiting over 300 disabled and elderly individuals. The court's conclusion with respect to private inurement is not surprising given the apparent failure of the organization to provide comparability data to support the amount of compensation paid to its founder.? What is, however, somewhat troubling is the relatively thin factual findings the court makes with respect to its conclusion that the organization had a substantial non-exempt purpose under the commerciality doctrine, in part because two of the three factors relied upon the court - a reliance solely on fees and significant profits - are not uncommon among groups that routinely qualify for section 501(c)(3) status.

In Family Trust of Massachusetts, Inc. v. United States, the plaintiff organization had sought a declaratory judgment that it qualified for tax-exempt status under section 501(c)(3) after the IRS had not ruled on its exemption application within 270 days.? As detailed in the opinion, the trust overseen by the organization permits disabled recipients of Supplemental Security Income, Medicaid, and other government benefits to benefit from assets, held by the trust, that normally would be in excess of federally allowed limits.? The court found two fatal flaws with the activities of the Family Trust.?

First the individual who founded and controlled the organization had received escalating compensation (increasing to $70,000 annually in 2009) as the net revenue from the assets controlled by the trust grew (reaching $362,524 in 2009), and the Family Trust failed to provide evidence that the amount received was reasonable in light of the services provided.? More specifically, while the Family Trust asserted it had gathered comparable compensation data through informal contacts with similar organizations, it failed to provide any specific comparability data to the IRS as part of the application process.?

Second, the court concluded that the Family Trust ran afoul of the commerciality doctrine because (1) it had relied solely on the fees it imposed on its members for its revenues, as opposed to contributions or other sources of income, (2) it had a significant profit margin (that correlated with the founder's increasing salary), and (3) the founder's dual role with the Family Trust and his elder law legal practice suggested that the availability of the trust was effectively a commercial product that enhanced the attractiveness of his legal practice to potential clients (some of whom also took advantage of the trust).?

Shakespeare in Love (1998): Marriage Duty

The clip marriage duty from Shakespeare in Love (1998) For Lady Viola De Lesseps, by the hand of Thomas Kent. "Shall I compare thee to a summer's day? Thou art more lovely and more temperate. Rough winds do shake the darling buds of May-" Two hours at prayer! Lady Viola is pious, my lord. Piety is for Sunday! And two hours of prayer is not piety, it is self-importance. It would be better that you return tomorrow, my lord. It would be better if you'd tell her to get off her knees and show some civility... to her six-day lord and master! Mmmph! My lady Viola. Lord Wessex. You've been waiting. I am aware of it. But it is beauty's privilege. You flatter, my lord. No. I have spoken to the queen. Her Majesty's consent is requisite when a Wessex takes a wife, and once given, her consent is her command. Do you intend to marry, my lord? Your father should keep you better informed. He has bought me for you. He returns from his estates to see us married two weeks from Saturday. You are allowed to show your pleasure. But I do not love you, my lord. How your mind hops about. Your father was a shopkeeper. Your children will bear arms, and I will recover my fortune. That is the only matter under discussion today. You will like Virginia. Virginia? Oh, yes. My fortune lies in my plantations. The tobacco weed. I need 4,000 pounds to fit out a ship and put my investments to work. I fancy tobacco has a future. We will not stay there long. Three or four years. But why me? It was your eyes.

Young cancer survivors often forgo medical care due to costs

Monday, September 24, 2012

Many survivors of adolescent and young adult cancers avoid routine medical care because it's too expensive, despite the fact that most have health insurance. That is the conclusion of a new study published early online in CANCER, a peer-reviewed journal of the American Cancer Society. The results indicate that expanding insurance coverage for young cancer survivors may be insufficient to safeguard their long-term health without efforts to reduce their medical cost burdens.

Medical care in the years after a cancer diagnosis is particularly important for detecting any long-term health conditions associated with their cancer treatment; however, little is known about the extent of care that survivors of adolescent and young adult cancers receive in the years after their diagnosis and treatment.

To investigate, Anne Kirchhoff, PhD, MPH, of Huntsman Cancer Institute at the University of Utah in Salt Lake City, and her colleagues analyzed national survey responses from younger adults ages 20-39 years: 979 who were diagnosed with cancer between the ages of 15 to 34 years and were at least five years from diagnosis, compared with 67,216 controls who had no cancer history.

While adolescent and young adult cancer survivors had similar rates of being uninsured as those without cancer (21 percent versus 23 percent), survivors were 67 percent more likely to forgo routine medical care due to costs in the previous year. Cost barriers were particularly high for younger survivors aged 20 to 29 years (44 percent versus 16 percent of controls) and female survivors (35 percent versus 18 percent of controls). Survivors reporting poorer health also experienced more cost barriers.

"The Affordable Care Act is an important step to ensuring that adolescent and young adult cancer survivors have health insurance coverage and improving their health care access; however, they need to be educated about the importance of regular health care to monitor for late effects," said Dr. Kirchhoff. "Furthermore, even the insured survivors in our study reported unmet health care needs due to cost barriers, suggesting that adolescent and young adult cancer survivors need resource supports beyond health insurance."

WebRTC - Mobile Communications Game Changer or Flash in the ...

Came across Erik Lagerway's interesting guest post on Gigaom.com discussing WebRTC and its potential to be a mobile game changer. WebRTC essentially embeds a standard-based real time Media Engine into all of the available browsers enabling real-time voice and video communication from your browser. Erik ponders the future leveraging WebRTC:

Imagine a world where no matter what we use or where we are we could all communicate via video, hassle-free, for free ? native video from Apple devices to Samsung devices, from business phones to the TV in your living room, from your car to your home to a beach in Hawaii. That is what WebRTC can do for us.

When it comes to mobile, Google and Apple own it. If these two giants got on the same page with WebRTC and convinced the mobile operators to play along, consumers everywhere would rejoice.

He goes on to explain that apps such as Skype, which is the standard bearer of desktop and mobile communications is essentially a dead-end approach when he writes:
So why won?t Skype dominate on mobile? Skype is an app on a device. It will never win the mobile battle if it?s just a third party application. Even if Microsoft embeds Skype deep in the fabric of its own mobile devices, that only represents a small portion of the market. And I don?t see Apple and Google embedding Skype as the native form of communication anytime soon.
Although I think WebRTC is promising, and I share Erik's vision of being able to video call from iPhone to Android to desktop PC, I think he underestimates the power of mobile apps. Look how Facebook recently switched from a HTML5 browser mobile app to a native iOS integrated app. Some of the advantages going native include: speed, gestures support, and access to smartphone's camera. Of course, WebRTC will also (eventually) have access to the smartphone's camera for each of the operating systems that support WebRTC. However, the speed of native apps over WebRTC or HTML5 web pages will still be a challenge.

The success of Apple's App Store with thousands of mobile apps -- and developers making good money at it too, means WebRTC will have to come up with a way of enticing developers and monetizing their efforts. Why would someone switch from a mobile Skype app to a browser-based WebRTC app that does essentially the same thing? Just because it's cool to run voice and video within your browser? That's not enough.

Perhaps click-to-call within your browser enabling customers frictionless (no registration) calling into a customer support queue might be one driving force. Tango is another strong mobile app that does VoIP, video, SMS, and even in-app social gaming. HTML5 + WebRTC could enable social gaming as well, making it a strong play for developers to build browser-based HTML5 apps for social gaming. There's potential for in-game purchasing from the browser like you see with native mobile games. HTML5 game development, should it ever rival Adobe Flash gaming means developers can write-once and have the code run cross-platform - from desktop PC to Apple iOS to Android to Windows Phone. In theory, any way - and don't get me started on the lack of support for Flash in Apple iOS! angry-fast-talking-tirade

Also, I do think WebRTC has strong potential in web conferencing, especially multi-party - think Google Hangouts - though ironically Google Hangouts doesn't use WebRTC. Still, the ability to send a URL via text, email, or IM to participants and then without having to download and install anything you can join the conference brings a huge upside to WebRTC. Still, I disagree with Erik on the future death of mobile (communications) apps in favor of communicating in your browser using WebRTC.

P.S. Check out TMCnet's WebRTCWorld, for some interesting insights on WebRTC, it's current state, and the future.
